Welcome to NYX Jewel
Welcome to the NYX Jewel website (“the Site”). NYX Jewel provides this Site as a service to its customers. By using this Site, you agree to follow and be bound by these Terms. If you do not agree to the Terms, please do not use this Site in any way.

Your Account and Password

Prices
Prices for our products are subject to change without notice.
We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice. We shall not be liable to you or to any third party for any modification, price change, suspension, or discontinuance of the Service.
We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders using the same billing and/or shipping address. If we make a change to or cancel an order, we may attempt to notify you by contacting you via e-mail and/or billing address or phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers, or distributors.
Availability
All orders for products are subject to the availability of those products and the materials for making them. We will inform you as soon as possible after receiving your order if, for any reason, the products you have ordered are not available or are subject to delay.
If we are unable to supply you with a product (for example, because a particular gemstone is out of stock or due to a pricing error), we will inform you of this by email and will not process your order. If you have already paid for the product, we will refund you the full amount as soon as possible.
Limitation of Liability
To the fullest extent permitted by applicable law, in no event will NYX Jewel or anyone representing NYX Jewel be liable to you under contract, tort, strict liability, negligence, or any other legal or equitable theory, for:
- Any lost profits, data loss, or cost of procurement of substitute goods or services
- Any direct, indirect, incidental, special, punitive, compensatory, or consequential damages of any kind whatsoever resulting from:
- (i) Your access to, use of, or reliance on any content provided through the services or any errors or omissions in any content;
- (ii) Any unauthorized access to or use of the services or NYX Jewel’s secure servers and/or any and all personal information and/or financial information stored therein;
- (iii) Any interruption or cessation of transmission to or from the services;
- (iv) Any bugs, viruses, Trojan horses, or the like that may be transmitted to or through our services by any third party (regardless of the source of origination);
- (v) Any products provided through or in connection with the service, including any allergic reactions or other skin conditions caused by or connected with the use of our products.
These limitations apply regardless of legal theory—whether based on tort, strict liability, breach of contract, breach of warranty, or any other legal theory—and whether or not NYX Jewel was advised of the possibility of such damages.
Warranty
